Every hospitality business in the UK that has made an unsuccessful insurance claim related to Covid-19 business interruption has cause to be encouraged.
As a French restauranteur has successfully gained a ruling in Paris against insurance giant AXA last Friday for Covid-19 related revenue losses.
This would seem to open many similar doors to similar claims in the UK.
French Covid-19 insurance ruling – The Paris court ruled against AXA saying they must pay the restaurant owner two months’ worth of Covid-19 related revenue losses.
The case was successfully brought by Stephane Manigold, the owner of four Paris restaurants.
His claim demanded AXA was bound by his policy to cover the operating losses of his restaurants following the French Government’s enforced lockdown regulations initiated in mid-March.
On hearing last Friday’s verdict, Manigold celebrated with friends to the applause of his many supporters across the French hospitality industry. Speaking with Reuters Manigold announced: “This is a collective victory.”
The court ruling found that the administrative decision to close the restaurant qualified for insurance cover as a business interruption loss.
Manigold’s lawyer, Anais Sauvagnac, said: “This means that all companies with the same clause can appeal to their insurers.”
AXA immediately issued a statement saying they would appeal the decision.
